Clinician Terms of Use

1. DEFINITIONS

  • "Company" means Traumalis, a Georgia LLC, and its affiliates, officers, directors, employees, and agents.
  • "Service" means the software-as-a-service platform provided by Company.
  • "Clinician" means licensed healthcare professionals authorized by Customer to access and use the Service.
  • "Customer" means the organization providing treatment to patient and employing Clinician.
  • "Patient" means individuals receiving care from Customer's Clinicians using Service.
  • "PHI" means Protected Health Information as defined under HIPAA.

2. ACCEPTANCE

By creating an account or using the Service, the Clinician ("you") agree to these Terms of Use as a licensed healthcare professional.

3. ACCOUNT RESPONSIBILITIES

3.1 Account Security: You are responsible for maintaining account confidentiality and all other activities under your account.

3.2 Authorized Access: Your access is provided through your healthcare organization's subscription.

4. PROFESSIONAL USE REQUIREMENTS

4.1 Licensed Practice: You are required to be a licensed healthcare professional to use the Service. You may only provide access to the Service with Patients receiving treatment at Customer. You must be appropriately licensed in the state in which you will provide the services and in the state in which each patient is located at the time of the provision of such services.

4.2 Clinical Supervision: The Service must only be used as a supplement to a comprehensive patient care plan. Patient must be under appropriate clinical supervision.

4.3 Professional Judgment: You maintain full responsibility for all clinical decisions and overall patient care, including but not limited to psychiatric diagnoses, treatment planning, and therapeutic decision-making.

5. CLINICAL LIMITATIONS

5.1 Support Tool Only: The Service provides clinical support information but does not replace professional medical judgment.

5.2 No Emergency Use: Do not use the Service for emergency or crisis situations or to aid in making urgent medical decisions.

6. DATA AND PRIVACY

6.1 Patient Information: Follow all applicable privacy laws and your organization's policies regarding patient information.

6.2 No PHI Storage: Currently, the Service does not store PHI, but this may change once appropriate safeguards have been implemented.

6.3 Professional Confidentiality: Maintain patient confidentiality in accordance with professional standards.

7. PROHIBITED ACTIVITIES

You may not: (a) share account credentials, (b) use the Service outside your professional practice, (c) input patient data without authorization, (d) attempt to circumvent usage limitations, or (e) violate any applicable laws or regulations.

8. DISCLAIMER

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES. COMPANY DISCLAIMS ALL WARRANTIES REGARDING CLINICAL ACCURACY, COMPLETENESS, OR SUITABILITY FOR SPECIFIC MEDICAL PURPOSES.

9. INDEMNIFICATION

You agree to indemnify Company against claims arising from your use of the Service or provision of patient care.
